Terms & Conditions - Photography Tours
DEFINITIONS:
To avoid doubt, throughout the terms and conditions, the following terms will have the corresponding meaning:- “We” or “Us” means Gill Fry Photography at NetworkSW, Fifth Corp P/L, IL and GM Fry Business Trust and its agents, contractors, representatives and consultants.
LIMITATION OF LIABILITY.
The registration form must be completed for each and every person booking a tour. The registration form on which your signature appears, or your payment of the deposit or total fee, will represent your acceptance of these terms and conditions.
You accept that Network SW and Gill Fry has no liability for any damages, losses, or expenses of whatever cause or nature, including those resulting directly or indirectly from events over which it has no control. Network SW shall have no responsibility for additional expenses due to unforeseen delays caused by weather, theft or other causes beyond our control. Network SW is not responsible for additional accommodation or travel costs. Network SW cannot assume any responsibility for loss or damage to baggage or personal property.
I unconditionally release and discharge Network SW and all personnel involved in the tour from all liabilities, claims and causes of action that may arise from any act, omission, default, failure or error on the part of Gill Fry Photography, Network SW occurring wholly or partially during the course of the tour and including whilst in transit to, from or during the tour.
FEES
The tour cost varies per tour.
Norway includes the tuition fees, accommodation for 6 nights, 6 breakfasts, 1 celebratory dinner, transfers from and to Leknes airport from the accommodation, Bus driver and travel via minibus during the tour, fuel costs, entrance fees to Nutsfjord. All other expenses, such as other meals and personal items, are the responsibility of the participants. The participant expressly acknowledges that the tour cost does not include any airfares, airport taxes, insurance, accommodation before or after the tour, or items of a personal nature.
Iceland includes the tuition fees, accommodation for 7 nights, 7 breakfasts, 1 celebratory dinner, transfers from and to accommodation in Reykjavik, Bus driver and travel via minibus during the tour, fuel costs, entrance fees where applicable whilst on the tour. All other expenses, such as other meals and personal items, are the responsibility of the participants. The participant expressly acknowledges that the tour cost does not include any airfares, airport taxes, insurance, accommodation before or after the tour, or items of a personal nature.
TRIP INSURANCE
The tour cost also excludes any insurance coverage for trip cancellation/interruption, travel accident, travel delay, baggage delay, loss or theft, acts of war, medical or hospitalization expenses. Insurance cover is mandatory for this tour. We recommend you contact your relevant insurer in relation to the above-mentioned insurance coverage. You will need to provide evidence of your insurance before undertaking the tour.
We recommend that you have personal health insurance and purchase emergency medical evacuation insurance and emergency medical expense coverage, and trip cancellation insurance, which, depending on the terms of your insurance, may reimburse you for non-refundable airfare and trip cancellation fees should you have to cancel the trip due to personal or family illness. Life insurance, baggage loss and baggage delay reimbursement plus other coverage is also advisable.
TRAVEL
Norway - All participants are responsible for making their own way to Leknes airport to commence the tour. All travel during the tour is included. After drop off at Leknes airport on the final day of the tour, the participant is responsible for making their own way to their next destination.
Iceland - All participants are responsible for making their own way to Reykjavik the day prior to the tour date to allow for a pickup on the morning of the tour start date. All travel during the tour is included. After drop off in Reykjavik on the final day of the tour, the participant is responsible for making their own way to their next destination.
WET WEATHER PLAN
Please note, if the skies are cloudy and minor rain predicted, the tour will still go ahead and you will learn the required techniques. I always recommend bringing a sturdy walking boots and a waterproof jacket and waterproof pants as the tour locations are generally subject to a wet location.
If we have minor drizzle or patchy showers we will be out there making the most of it as these conditions often add to the mood of our scenes.
LEVEL OF EXPERIENCE AND FITNESS LEVEL
You will get a lot out of this tour regardless of your experience level. I ensure the group is small so that I can dedicate personal time to each person to help improve your skills and capture some great images.
A reasonable level of fitness is required for this tour. There will be considerable walking, with a lot of it on uneven terrain or with steps. Although I have tried to ensure a lot of the places are an easy/moderate walk, there will be times and places where you will need to exert yourself. Note - you will have to walk over irregular terrain and carry equipment in the dark!
Sturdy walking shoes are a must! Walking poles are encouraged if you are a little unsteady on your feet.
Please call us if you have any questions about your ability to do a particular tour. Once a tour has started and it is necessary for you to leave the trip because it is beyond your physical level, please note that there will be no refunds for any unused portion of the trip.
MEDICAL
You must generally be in good health and it is vital that persons with medical problems make them known to us well before the tour begins. Although all tours carry a field safety kit containing general first aid items, it is understood that Gill Fry Photography assumes no liability regarding provision of medical care or provision of medical advice in relation to the tour. Trip members are urged to check their coverage to be sure it is adequate and to consult their physician prior to participating in the tour.
REFUND POLICY
To secure your booking, we require a $2000 deposit at the time of booking or full payment if there is less than 60 days to the tour start date. If for any reason you need to cancel your participation in the tour, please notify us at least 60 days before the start of your tour. At that time, we will refund your amount paid minus a $500 administration fee.
If notification of cancellation is 30-59 days, we will refund you the amount paid minus $1000 to help cover any costs we have already incurred.
If notification of cancellation is made less than 30 days before the start of a tour, we reserve the right to retain the full tour fee. Your fee paid will be refunded minus $1000 if, and only if, we can find someone to fill your spot.
CANCELLED TRIPS
Although Gill Fry Photography has rarely cancelled tours, we reserve the right to cancel any tour for any reason whatsoever, including too few participants or logistical problems such as strikes, wars, acts of God, pandemic or any other circumstances, which may make operation of the tour inadvisable or unviable, including the safety and security of participants and their equipment.
Tour payments, which were received in relation to a cancelled tour, will be promptly refunded minus $500, provided it is greater than 30 days to the tour commencement date. If less than 30 days to the beginning of the tour, the tour payment paid minus $1000 will be refunded. It will only be in extreme circumstances that are beyond our control that this will occur. We expressly state that we will not be responsible for any costs associated with travel, accommodation, insurance or any other costs other than the tour cost that may be associated, either directly or indirectly, with the cancellation of a tour.
In the event that Gill cannot attend due to ill health or circumstances beyond her control, we will endeavour to get a suitable photography teacher replacement so that the tour can proceed. If no suitable replacement can be found, the tour will need to be cancelled and the above refunds stated will apply.
LIMITATION OF LIABILITY.
This section defines our responsibility with respect to all of our tours. PLEASE READ IT CAREFULLY. Payment for your booking represents your acceptance of all terms and conditions outlined anywhere within this brochure. The tour application must be completed for each and every person booking a tour. The tour application on which your signature appears will further represent your acceptance of these terms and conditions.
By signing this document or making payment for this tour you hereby accept that Gill Fry Photography has no liability for any damages, losses, or expenses of whatever cause or nature, including those resulting directly or indirectly from acts of God, detention, annoyance, weather, quarantines, strikes, civil disturbance, war, theft or criminal activity of any kind, government regulations, etc., over which it has no control.
Without limiting the above paragraph, Gill Fry Photography shall have no responsibility for additional expenses due to unforeseen delays caused by weather, earth events, theft or criminal activity of any kind, political disputes, acts of terrorism, war, strikes, sickness, failure of flights or other transportation to arrive or depart on time, and other causes beyond our control. Gill Fry Photography is not responsible for additional hotel nights not specified in the tour itineraries which may be required en route, prior to or following a trip, caused by airline scheduling or schedule changes, or by individual clients’ travel arrangements or by other factors. Gill Fry Photography cannot assume any responsibility for loss or damage to baggage or personal property.
IN NO EVENT SHALL Gill Fry Photography HAVE ANY LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, HOWEVER CHARACTERIZED.
Gill Fry Photography reserves the right to substitute hotels, conference facilities, and to alter the itinerary when deemed necessary or advisable. The right is also reserved to cancel any tour prior. Gill Fry Photography is not responsible for additional expenses incurred by trip members in preparing for the trip (i.e. non-refundable advance-purchase air tickets, equipment, etc.)
Gill Fry Photography reserves the right to decline to accept or retain any person or member of any trip should such person’s actions or general deportment impede the operation of the trip or the rights or welfare or enjoyment of other members of the trip, and it is agreed that no refunds will be given in such circumstances.
Gill Fry Photography reserves the right to take photographic, film or video records of any of our trips, and may use any such records for promotional and/or commercial purposes without the requirement for a signed release from any members captured in film or digital media.
PRIVACY
Other than the standard internet data, Gill Fry Photography does not collect or use any of your personal information unless specifically authorised or permitted pursuant to the Privacy Act 1988.
DEED OF RELEASE, INDEMNITY AND WAIVER
In consideration of Gill Fry Photography permitting me to participate in the tour, I hereby agree as follows:-
ACCEPTANCE OF RISK
1. The information I have provided in this document is true and correct and I understand that Gill Fry Photography is relying on that information in allowing me to participate in the tour.
2. I certify that I have been advised of the inherent risks, if any, associated with the tour and I voluntarily choose to participate in the Gill Fry Photography Tour, fully accepting that the materialization of any such risks may cause damage to my person or property.
3. I acknowledge and agree that I have read and understood all of the Terms and Conditions in relation to my participation in the tour and the costs associated with the same.
RELEASE AND DISCHARGE
I unconditionally release and discharge Gill Fry Photography from all liabilities, claims and causes of action that may arise from any act, omission, default, failure or error (including any negligent act, omission, default, failure or error) occurring wholly or partially during the course of the tour and including whilst in transit to or from the tour. I acknowledge and agree that this is in addition to any other release and indemnity provided by me by agreeing to the Terms and Conditions of my participation in the Gill Fry Photography Tour.
INDEMNITY
1. I agree to indemnify and keep indemnified, Gill Fry Photography from any liability, claim or cause of action that may be brought against Gill Fry Photography as a result of or in connection with any act, omission, default, failure or error on the part of Gill Fry Photography (including any negligent act, omission, default, failure or error) occurring wholly or partially during the course of the tour including transit to or from the tour.
2. I hereby waive any right to claim and agree that Gill Fry Photography will not be liable for any loss or damage, personal injury, death, economic loss or consequential loss whether in tort, in contract, under statute or otherwise for any default, failure, negligence or error on the part of Gill Fry Photography.
